Lord Mandelson confirms internet cut-off for illegal file sharers

But will he still be in office then?

Business secretary Lord Mandelson has confirmed the government's 'get tough' policy on illegal file sharing, with persistent illegal downloaders looking at being cut off from the net from summer 2011.

Speaking at the government's digital creative industries conference, he said net connections could and would be blocked, but only as a last resort, claiming that a 'legislate and enforce' strategy was the only way to protect the intellectual property rights of content producers. 'Three strikes is a reasonable way of describing our approach,' he said.

To get cut off, you'll need to be pretty persistent in your activities. From around April next year, anyone suspected of illegal file sharing will get a warning letter, with the effectiveness of these letters being monitored for the first 12 months. If illegal filesharing has not dropped by 70% by April 2011, then cutting off people's internet connections could be introduced three months later, from the summer of that year. That is of course, if the same government is in or the new one has the same views on cutting off net access.

'If we reach the point of suspension for an individual, they will be informed in advance, having previously received two notifications – and will have the opportunity to appeal,' Mandelson added. 'The British government's view is that taking people's work without due payment is wrong and that, as an economy based on creativity, we cannot sit back and do nothing as this happens.'

There would be a 'proper route of appeal' for those that do have their internet accounts suspended, although who will play judge and jury to that isn't clear, an 'independent body' is all we've got to go on. We expect a succession of 'it wasn't me, someone jumped on my insecure router' defences testing the enforcement body to its limits in the first few months as a nailed-on certainty. Whether that actually works as a legitimate defence reamins to be seen.
